| Sorry to hear about you being rear ended. I hope you are ok though. Is it possible to fix or just too much trouble? Hope you get what you want out of this. |

I'll heal in time, big 8 inch round bruse on my right seat.
I read some one took cash to fix and had a heck of a time fixing it. Couldn't find the parts. |

| I think you should let insurance decide. If frame bent they will probably total it. If the price of parts are more than 50% of the bike than they will total it. My guess is they will total it. Once they decide its totaled, take off any upgrades that you have installed. You can sell the upgrades on ebay, or take what the insurance co gives you and get a used swing, and put them on that.

| Sorry to hear about your incident. What the #*#k is wrong with some drivers? How can they be so stupid as to rear end someone, whether a bike or a car? Oh yeah, Florida lets you do pretty much anything behind the wheel. I was afraid to go riding with model28a when I was down there. Until handheld device usage is eliminated, I won't drive a motorcycle in any jurisdiction that still allows their use. I hope the driver was charged with some type of moving violation.

| Sorry to hear about your collision. I would definitely not make any decisions about your Swing until insurance sorts it out. After obvious damaged parts are replaced, you may still have a bent/tweaked frame. Once you sign off on an insurance settlement, you'd be stuck with any problems that may crop up later. Assuming the driver had insurance, I'd ask for not only compensation for your Swing, but for personal injuries, even if they don't appear serious now. I still hurt now from an collision I had in 1981 where I let the other person off too easy.
My recommendation: Let them total your Swing, see if you can keep it as part of the settlement and then part it out if you want to do that, and get a good newer one.

| total is probably better----but we do not know year or normal retail value. These things are not cheap to fix!! Get money buy back from insurance company fix yourself. Sell.
I was hit from behind at stop sign--lady on cell phone---Reflex, hit didn't hurt, but I ended up on roof of Dodge mini-van, but the fall with the bike on top of me DID. Reflex total---I took money bought new bike, bought the totaled Reflex from ins. co.---did no work and somebody was happy to buy it. |

Here the police service and all media reporting "accidents" never use that term any more. It's only called a collision now. By definition, an accident is something over which there is no control, as in a meteorite or lightning bolt hitting you in the head. Vehicles colliding or going out of control are avoidable, thus it's called a collision. |

Typical insurance company stalling tactic when they know they'll eventually have to pay out. Might be time to call a lawyer, or at least threaten to considering the nature of your injuries. Sounds like your total loss including medical bills and damage to your Swing would exceed what you could try and recover in small claims court.
On Jan 2 of '09 an 89 year-old lady knocked me off my Swing when she decided to do a quick lane change when I was even with her left quarter panel. I got some good road rash on my knees and some scraped panels on my Swing. My insurance (Geico) fixed my Swing under my collision coverage and even waived the deductible. The other party was found to be at fault, so Geico would recover their payout from the other person's insurance. The other parties' insurance adjuster did come to my house to discuss my injuries and lost work income while I was out. |
